1. About these terms

These Terms of Use govern your use of all three parts of webstersantafe.com:

webstersantafe.com — Webster Santa Fe, our editorial and city guide site
webstersantafe.com/fine-art/ — Webster Collection, our fine art gallery and its online shop
webstersantafe.com/real-estate/ — Webster Estates, our real estate practice

All three are operated by Webster Enterprises, LLC at The Plaza, 54½ Lincoln Avenue, Santa Fe, NM 87501, USA. In these terms, “we,” “us,” and “our” mean that company, and “the Sites” means all three sites above.

By using the Sites you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Sites. We may change these terms, and changes take effect when posted on this page.

2. Who may use the Sites

You must be at least 18 years old, or have a parent’s or guardian’s consent, and have the legal capacity to enter a contract.

3. Content on the Sites

Text, photographs, artwork images, graphics, logos, video, and code on the Sites belong to us or to our licensors, including the artists, photographers, and estates whose work we represent. You may view and share pages, and quote briefly with attribution. You may not reproduce, republish, distribute, or create derivative works from our content, or use it commercially, without our written permission.

“Webster Santa Fe,” “Webster Collection,” and “Webster Estates” are our names and marks. Other names and marks on the Sites belong to their owners.

4. Acceptable use

Please do not:

attempt to gain unauthorized access to the Sites, our accounts, or our systems
scrape, harvest, or bulk-copy content, images, or listing data
interfere with the operation of the Sites, or circumvent their security measures
submit false information, impersonate anyone, or submit another person’s personal information through our forms
use our forms or email addresses to send spam or solicitations

5. Purchases from Webster Collection

This section applies to orders placed through the shop at webstersantafe.com/fine-art/.

a. Orders

You can check out as a guest. After you place an order you will receive a confirmation email. That email confirms we received your order; it is not acceptance of it. We may accept or decline any order, including after the confirmation is sent, and will tell you promptly if we decline.

b. Availability

Works are sold subject to availability, and much of what we offer is unique or very limited. If a work is no longer available after you order it, we will contact you and refund the payment for that item.

c. Prices

Prices are in US dollars and are shown without tax. Sales tax is calculated at checkout based on your shipping address. Prices may change at any time. We try to keep prices accurate, and if a work is listed at an incorrect price we may cancel the order and refund you rather than fulfill it at that price.

d. Payment

We accept the payment methods shown at checkout, currently credit and debit cards, Link, Amazon Pay, Klarna, and Affirm, processed by Stripe. Pay-over-time options are offered by the provider you choose, subject to that provider’s approval and its own terms. By submitting payment information you confirm you are authorized to use that payment method.

e. Shipping and delivery

We ship within the United States only. Shipping within the US is free, as shown at checkout. If you are outside the US and would like to buy a work, contact us and we will discuss what is possible.

Title and risk of loss pass to you when we deliver the work to the carrier.

Delivery estimates are estimates. We are not responsible for carrier delays, customs processing, or other causes outside our control, but we will keep you informed and do what we can to help.

f. All sales are final

All Webster Collection sales are final. We do not accept returns or exchanges. Please ask us anything you want to know about a work before you buy it, and we will answer fully and honestly, including about condition and provenance. Call us at 505-954-9500 or use the contact details in section 13.

This does not affect the two cases in this section where we refund you because we cannot complete the sale: a work that is no longer available, and an order placed at an incorrect price.

6. Real estate information from Webster Estates

Everything on the Webster Estates site is provided for general information. It is not an offer or a solicitation to buy or sell property, and it is not an offer of representation.

Listings, prices, availability, and property details may change or be withdrawn at any time without notice.
Property information, including measurements, acreage, zoning, water rights, and tax figures, comes from sources we believe to be reliable but is not verified by us and should be independently confirmed by you and your advisors.
Market reports, guides, and journal articles reflect conditions as of their publication date and are not a prediction, an appraisal, or a valuation of any property.
Nothing on the Sites is legal, tax, financial, investment, appraisal, or inspection advice.

Using the Sites, submitting an inquiry, or receiving information from us does not create a broker-client, agency, or fiduciary relationship. Any such relationship begins only under a signed written agreement.

7. Editorial content on Webster Santa Fe

Our Santa Fe guides, event calendars, and articles are general information about the city and the region. Details such as hours, dates, prices, and whether a business is still open change without notice, and we cannot guarantee that any of it is current. Mentioning a business, event, or organization is not an endorsement of it, and we are not responsible for anything you buy from or arrange with a third party you found through our pages.

8. Forms and messages you send us

Information you submit through our forms is handled as described in our Privacy Policy. Our forms are protected by Google reCAPTCHA, which is subject to Google’s Privacy Policy and Terms of Service. Do not send us confidential or sensitive information, or another person’s personal information, through a website form.

9. Links to other sites

The Sites link to other Webster family websites and to third-party sites. We do not control those sites and are not responsible for their content, products, or practices.

10. Disclaimer

The Sites and their content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Sites will be uninterrupted or error-free, or that the content is complete, accurate, or current. Nothing in this section limits any warranty that applies to a work you purchase from us, or any right you have under law that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Sites or your purchase of a work, including lost profits, lost data, or loss of goodwill. Our total liability for any claim will not exceed the amount you paid us for the work or service the claim relates to.

12. Governing law and disputes

These terms, and any dispute arising from the Sites or from a purchase, are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules.

Any dispute arising from these terms, from your use of the Sites, or from a purchase will be resolved by binding arbitration rather than in court, and you and we each waive the right to a trial by jury. Arbitration will take place in Santa Fe County, New Mexico, under New Mexico law. This applies to all three of the Sites. Either of us may still bring a claim in small claims court if it qualifies, and nothing here waives a right that cannot be waived by law.
